关于规划地方立法实践中的困惑与思考——以深圳为例

在规划的地方立法方面,深圳特区进行了大量的实践活动,在取得成功的实践经验的同时,也存在诸多困惑,如特区立法权的适用范围有限、规划的地方法规体系不健全、法规的法律效力等级低、对规划立法的计划性不足、对审批程序缺乏明确的规定等,因此,应形成逐步提高地方立法的法律效力和稳定性的基本思路,充分利用地方立法的资源和优势,明确立法工作的目标和内容,提高立法技术,为城市规划和建设工作提供全面的法律制度保障.

The Puzzle and Reflection over the Practice of Local Legislation for Planning——Take Shenzhen for Example

As far as local legislation for planning is concerned, a great deal of practice has been carried out in Shenzhen. While practical experience in success has been obtained, there also exist many puzzles such as the limit of the applicable scope of legislation of the Special Economic Zone, the imper- fection of the local legal system for planning, the low level of legal efficacy, the lack of plan for legis- lation for planning, and lack of specific regulations for approval procedures, etc. Therefore, it is nec- essary to establish a basic idea to gradually im- prove the legal efficacity and stability of local legislation. Full use must be made of the resources and advantages of the local legislation to specify the goal and content of legislation work and to im- prove the legislation technology so as to provide an overall legal guarantee for urban planning and ur- ban construction.
