浅谈施工中的工程索赔

索赔是指在经济合同实施过程中,合同中的一方因对方不履行或不完全履行合同所规定的义务,或者由于对方的行为使权利人受到损失时,向对方提出的赔偿要求的权利。在工程建设中,索赔的范围较为广泛,一般包括未履行或未正确履行合同所规定的义务、指令变更、修改设计、工程环境变化、地质条件与设计不符、国家法令变更、通货膨胀等,都会导致索赔事件的发生。施工索赔就是承包商由于非自身原因发生合同规定之外的额外工作或损失所要求进行的费用和时间的补偿。

Claims in Project Construction

Claim is the right of a party of a contract for compensation of losses which the party incurred due to default of the other party of the contract during performance of the contract.During construction of a project,claims may occur in various areas including not fulfilling or incorrectly fulfilling the contract obligations of a party,instruction changes,design changes,the project environment changes,contradictions of the exposed geologic conditions with those expected in design,state law changes,inflation etc..Usually construction claims are cost/time compensations required by the contractor because of extra work or losses incurred by the contractor.
