| 摘 要： | 刑法适用的过程就是刑法解释的过程。刑法有各种解释方法,在适用于个案时如何选择和使用,关系到能否得出合理的结论,实现具体的正义。刑法中具有独立意义的几种解释方法存在位阶关系。其中文理解释是首选的解释方法,文理解释出现复数结果时采用体系解释,而目的解释是最终的解释方法。

| Abstract: | Criminal application is a process of criminal law interpretation.There is a variety of interpretation methods in criminal law.When applied to specific case,whether the conclusion is reasonable and the achievement of specific justice is made depend on the choice and application of the interpretation.There is a legal hierarchy in the application of the several interpretation methods which have independent significance.Literal analysis is the preferred method.When several results come out by means of literal analysis,the system interpretation should be used.Aims interpretation is the final method. |
