| Abstract: | In this paper the legal effect of claims and equal rights of claim party are introduced. Claim is supplement of contract and is a redistribution of the rate of assumption of risk. In the future the claim and counter claim will be paid more attention in engineering construction, and claim will become the center of contract management of construction engineering. |
