| 摘 要： | 矿产资源作为民法中重要的物，如何对其进行立法规划以达到对它的有效利用，是我国乃至世界所共同关注的问题。我国现行矿产资源立法是将矿产资源划归国家单一所有，同时建立一种他物权即矿业权，以实现对矿产资源的实际利用。这种立法模式对于实现所有者权益和所有人与矿业权人权利、义务的划分等方面存在很大的弊端。笔者尝试从物的角度对矿产资源、矿产和矿产品的独立性进行分析，并根据一物一权原则提出建立各级矿产所有权制度，以其代替矿业权制度。

| Abstract: | As mineral resources in civil law important thing, how to reach the effective use to it correctly through legislation jis an attentive question for our country and even the world. The mineral resources belong to the state singly and ste up mining right at the same time in our current mineral-resouces in order to realize the actual use to the mineral resources. Such legislative mode have heavy drawback to ralize owner rights and division of the right and obligation of mining right. This assay try to set up the ownership systems of mineral products at all levels according to a right and a thing principle to substitute mining right system analysising about the independent character of mineral resources, miner and mineral products. |
