国外典型国家矿业权管理经验及对我国新形势下矿业权管理的思考与启示

矿产资源是支撑工业化社会发展的物质基础,矿业权管理在保障国家矿产资源权益,维护矿业权人合法权利等方面具有重要作用。21世纪以来经济快速发展对矿产资源的需求大量增加,在新时期许多国家都制定或推行了新的矿业权管理制度和政策。由于国情不同,各国实施的矿业权制度和措施也有所差别。本文立足我国矿业权管理现状,考虑新形势对矿业权管理的新要求,通过借鉴国外典型国家矿业权管理经验,为新形势下我国的矿业权管理提出几点思考与启示。

Mineral rights management experience of foreign typical countries and the inspiration and reference of China

Mineral resources are the material base to support the development of industrial society, management of mining rights,plays an important role in guarding national mineral resources rights and interests, legitimate rights and mining rights of the obligee. Since twenty-first century the demand for mineral resources has increased a lot with rapid economic development, in the new era, many countries have enacted or introduced new mining right managements system and policy. Because of different national conditions, the mining right system and measures in various countries are also different. This paper, based on the present situation of mining rights management in China, considering the new requirements of the new situation of mining right management, through using the overseas typical experience about mining right management, put forward some considerations and enlightenments for the mining rights management in our country under the new situation.
