苏州河网水环境保护法律制度的完善

指出关于苏州水环境的现有法律保障体系存在局限性;如:统一协调管理制度、排污收费制度、清洁生产制度、生态修复制度以及水资源补偿机制等方面。为完善法律制度,建议:①明确苏州市水利和环保部门的职责分工;②全面考虑排污对整体水资源的影响,要提高排污成本,从而有效地制止排污;③规定清洁生产是企业的义务,不履行者给予处罚;④需要立法修复生态,明确生态修复制度,制定生态规划;⑤明确水资源利用者对保护者的补偿机制,受益者对受害者的补偿机制等。

Improvement of legal system for water environmental protection of Suzhou river network

The existing legal systems for water environmental protection in Suzhou have some limitations in the aspects of uniform coordination and management system,pollution charge system,clean production system,ecological remediation system,compensation system of water resources,and so on.In order to improve the laws,suggestions are made as follows:(1) The function of water conservancy department and environmental protection department should be divided definitely;(2) The overall impacts of pollution discharge on water resources should be taken into consideration and the pollution discharge cost should be raised in order to control sewage discharge effectively;(3) Clean production should be the liability of enterprises and those who violate it should be punished;(4) Ecological remediation system should be established by legislation and ecological plan should be drawn out;(5) Compensation system should be definitely established,which can authorize the environmental protectors or the aggrieved parties to get compensations from the users or the beneficiaries.
