不动产地下空间权利界限确定方法

摘    要:立体化城市开发是今后城市空间利用的重要方向,现大部分城市使用的二维登记方法难以满足不动产地下空间的登记需要。文章结合既有法律法规及相关政策,对建设用地使用权进行细化,提出三维空间下的不动产地下空间权利体系;利用界址点、界址线、界址面三大类不动产空间元素提出确定不动产实体地下空间权利的方法,并在此基础上研究是否有用地红线、不同类型空间实体形态以及与其他地下空间实体之间不同位置关系的不动产地下空间实体权利界址确定与登记方法。目前,该方法已应用于广州地铁石壁站7号线站体的不动产登记工作并办理不动产权证书,实践可行且可推广使用。

Abstract:Three-dimensional urban development is an important direction for future urban space utilization. At present, the two-dimensional registration method used in most cities is difficult to meet the different registration needs in underground space. Based on the existing laws, regulations and relevant policies, this paper details the right to use construction land, proposes rights system of underground space real estate. Relying on three major elements of boundary point, boundary line and boundary surface, a confirmation method of underground space real estate rights boundary with different vertical levels, spatial forms and construction way was proposes. The proposed method has been applied to real estate registration in Line 7 station body of Guangzhou Shibi metro station and handled the real estate rights certificate, which proved to be feasible in practice and can be popularized.
