| 摘 要： | 物权行为理论是一个非常具有理论美感的理论,但是多年来关于它的论争从来没有停止过。肯定者不能解答否定者提出的质疑,否定者也无法忽视该理论的重要价值。本文仅仅试图通过对物权行为理论和各国物权变动立法模式的简介,从实证法角度分析我国对于物权行为理论的规范立场,并对这种规范立场的由来和合理性提出自己的浅见。
