针对目前我国劳务(雇佣)合同立法缺失所导致的人们对外派劳务合同法律关系的认识莫衷一是,及仲裁和审判实践的矛盾与冲突,从分析外派劳务合同与劳动合同的不同特征入手,揭示了两者之间是平等民事主体之间的民事法律关系和不平等民事主体之间的劳动法律关系的本质区别,并依据现行法律法规规章及规范性文件,阐述了处理外派劳务合同纠纷应当适用的法律及依据。
