| 摘 要： | 夫妻财产约定不同于赠与合同,因规范目的、法律效果、社会价值相异,纳入到约定财产制中,按照婚姻关系处理。同时夫妻财产约定也不同于其他财产性约定。夫妻财产约定中的物权变动始于协议成就,无需交付或登记,但不得对抗与夫妻一方或双方存在交易关系的善意第三人。
