摘    要:在建设工程项目中,承包合同规定了业主和承包商之间权利和义务,是双方最高的行为准则,一切工程活动都是为了实现和履行合同中各项条款,而计价方式作为承包合同的重要组成部分,决定了大部分工程风险在业主和承包商之间的分配方式。本文介绍了当前国际工程项目中使用较多的几种合同计价方式,分析了各自的优缺点以及在各种计价方式下工程风险在业主和承包商之间的分配方式。最后指出业主应根据具体项目的特点,结合自身的情况,灵活选择合同计价方式,并积极就合同计价方式进行创新。

Abstract:In the construction projects, the contract, which is the most important behavior norm, determines the rights and responsibilities of client and contractor. All engineering activities aim at implementing and carrying out the articles of the contract. However, as the key component of the contract, the type of contract price determines the distribution mode of most of the engineering risk between client and contractor. In this paper, the most popular types of contract price used in the international construction projects are introduced. The advantages and disadvantages of each type and the distribution mode of the engineering risk between client and contractor are analyzed. At the end, some advice are given to the clients that they should choose the proper type of contract price and have innovation according to the characteristics of certain project and the situation of themselves.
