从一起失火案看目前证据搜集中的瑕疵

通过一起失火案引发的讼诉，剖析消防救援队伍火调工作遇到的难题，对火调认定中“不排除表述”的使用进行了研究，探讨了火灾原因认定过程中证据搜集方面存在的瑕疵，并从司法角度对证据搜集、原因认定意见的准确表述提出了新的视点；论述了刑事诉讼中证据链的唯一性、排他性；分析了目前失火案办理困难的深层次原因，提出了建立改进火灾调查中证据搜集形式、方法以及增强证据说服力的建议，对消防应急救援队伍转型后的火灾调查工作有一定的借鉴，对认定火灾原因、对火灾中各方责任的厘清具有一定参考价值。

Discussing the flaw of evidence collection from a fire case

Througha lawsuit caused by a fire case, this paper analyzes the difficultiesencountered by the fire and rescue team in the fire investigation work, andstudies the use of "not excluding expression" in the fire causeidentification. This paper probes into the forms of evidence collection in theprocess of fire cause determination and the defects existing at present, and fromthe angle of judicature, the accurate expression of evidence collection andcause determination opinions are provided. This paper expounds the uniquenessand exclusiveness of evidence chain in criminal procedure, analyzes thedeep-seated reasons for the difficulties in handling fire cases at present, andadvances some suggestions on establishing and improving the forms and methodsof evidence collection in fire investigation and on strengthening thepersuasiveness of evidence. It has some reference value to the fireinvestigation after the transformation of fire emergency rescue team, to theidentification of fire causes and to the clarification of the responsibilitiesof all parties in fire.
