施工企业的工程索赔管理

摘    要:索赔是工程承包过程中经常发生的事件。“低中标,勤签证,高索赔”在国际工程建设领域耳熟能详,但在我国工程建设市场,尚未被承包商充分认识和利用,或者即使拥有索赔的权利,也不知如何索赔,甚至不敢索赔。正确的工程索赔,对改善工程承包效果具有很大影响。熟悉国际惯例及经济合同法,掌握产生索赔的各种因素,明确索赔的依据,重视索赔的管理,可以使承包商在激烈的工程建设市场中减少或避免损失,取得较好的经济效益。

Abstract:Claim often occurs in project contract. "Low bidding, frequent vise and high claim" is well known in international engineering construction field. But, in our engineering construction market, it has not been well known and fttlly used by contractors; or, even though we have right to claim, we do not know how to claim and even dare not to. A correct project claim affects greatly the effect of project contract. To be familiar with international institutions and economic contract act, master various factors for claim, be clear accordance of claim, and to pay attention to management of claim can reduce or avoid loss for contractors in fierce engineering construction market and make better economic benefit for the contactors.
