| 摘 要： | 应急管理与财产权保护的关系是应急权力的限制与财产权的保护之间关系的利益平衡。本文介绍了大陆法系和英美法系中对应急管理与财产权保护的典型立法例，并作出了应急管理与财产权保护的法律基础分析。应急管理与财产权保护机制不仅应在实体法上进行规定。而且应当有完善的程序法规定。在此基础上，本文将应急管理与财产权保护类型化为事前预防机制、事中保护机制和事后救助机制。

| Abstract: | The relationship between the balance of interests between the This paper introduced the typical le the emergency management and the protection of the property is restriction of emergent power and the protection of the property. gislations of the protection of property in the emergency manage- ment in the civil law system and the common law system, and analyzed the legal basis of the protection of property in the emergency management. The system of the protection of property in the emergency management should not be prescribed in the substantial law, but also should be prescribed in the procedural law. On this basis, this paper categorizes the protection of property in the emergency management, including the system of prevention, protection and assistance. |
