建筑设计作品的著作权保护

作品是著作权保护的直接指向物。著作权是知识产权的一种,是一种特殊且重要的民事权利。建筑设计是一项极具创造性的工作,建筑设计作品是著作权保护作品的题中应有之义。建筑设计作品具有实用性、艺术性和科学技术性的综合特点,与其他一般作品相比,其著作权问题具有较多的特殊性。本文运用著作权制度的基本原理,探讨建筑设计作品的内涵、著作权保护的范围、建筑设计作品著作权保护的适用条件和措施以及建筑设计作品的著作精神权利和经济权利等内容,初步构建建筑设计作品著作权制度的理论框架。

Copyright Protection for the Works of Architectural Design

The copyright protection is directly linked to the works. Copyright is one of the intellectual property rights, one kind of very special and important civil rights. The architectural design is work full of creativity, so the works of architectural design shall be protected by the copyright protection. The works of architectural design integrate the features of practicability, artistry and technology. Their copyright is special compared with that of other works. This paper used the fundamental principle of copyright system to discuss a variety of topics, including the connotation of the works of architectural design, the scope of copyright protection, the application clause and measures for the copyright protection of architectural design, and the personal rights and property rights for the author of the architectural design works. The overall paper made up the theoretical frame for the copyright system of the architectural design works tentatively.
