| 摘 要： | 水电工程房屋征收补偿,适用的条例包括国务院471号令与国务院590号令,两个条例存在交叉重合之处。为避免立法不明带来的法律适用困难,采用比较的方法对两者进行对比分析,并提出由国家层面出台法律解释或修订现有条例,以明确水电工程不适用590号令、针对目前两个条例均适用的情况,并提出分类处理办法。

| Abstract: | Currently,applicable regulations of house expropriation and compensation in hydropower projects include the No. 471 and No. 590 decrees of the state council. However,overlap is observed in the application scope of these two decrees,which causes legal difficulties in their application. A comparative study on these two regulations is thus carried out. National legal interpretations or revision of the regulations are suggested to clearly define the proper ways to manage the cases when the No. 590 decree is not applicable or both decrees are applicable in hydropower projects. |
