基于法律事实建构的工程计量对合同状态补偿的研究

业主与承包商就工程价款计量支付问题出现纠纷是工程项目普遍存在的现象,究其原因,由于合同实施过程中的干扰因素打破了合同签订时初始状态的平衡,而业主并未施与承包商这种合同状态变化的有效补偿。针对工程实践中的上述现象,基于法律事实建构论的视角,利用演绎法将客观事实形成法律事实的路径应用到工程计量支付中,结合现行合同范本、《建设工程工程量清单计价规范》(GB50500-2013),分析工程计量支付中的建构要素和建构路径,解析工程计量对合同状态补偿实现问题,并总结出基于13版清单计价规范的工程计量支付证据及支付程序,以规范工程实践中的计量支付活动,有利于实现工程计量对合同状态的动态补偿。

Compensation of Re-measurement for Contract Status Based Upon Legal Facts Construction

Currently,the disputes on re-measurement and payment of the project cost between the employers and contractors in the projects is very common. Such situation can be caused by the interference factors in the contract execution process,which can break the balance of the original state when the contract is signed but the employers cannot implement the effective compensation for the contract change state of the contractor. For the above phenomenon in engineering practice,perspective of the based on the presumption on the legal fact,the reasoning deduction method is used to convert the objective facts to be the directory application of the legal facts,which is further used to pay the bill of quantities and analyze the construction elements and construction path in the payment of bill of quantities,Combining with the current contract model and the Code of bills of quantities and valuation for construction works of 2013,then summarized measurement payment evidence and payment procedures based on 2013 quantity bill of calculating price to standardize the measurement payment activities in the engineering practice,which is beneficial to realize the measurement of dynamic compensation contract status.
