| 摘 要： | 从微观和宏观视角分别研究民事诉讼的运行和相关法律的规定，解释当事人在诉讼中的程序性选择及其原因，在此基础上从整个社会的角度研究立法的规定，为不同类型的民事纠纷设定相应的解决机制。

| Abstract: | The paper analyzes the system of civil procedure from micro-perspective and macro-perspective, explaining people＇s choice about the formalities of civil procedure and its reason. On the base of these analyses, we can investigate the legislation from social perspective, and constitute rational system for different civil disputation. |
