| 摘 要： | 民事人身伤害赔偿应当对人身权本身受到伤害后的法律救济，精神赔偿应列入赔偿范围，对赔偿范围，赔偿数额的计算应作出进一步的具体法律规定，执法者不应拥有过大的自由裁量权。
