略论我国民事诉讼中的证明责任倒置

《证据规定》第四条关于特殊侵权案件的证明责任分配的规定,将其一概归纳为证明责任倒置的观点是十分片面的,其中多数规定应该理解为证明责任分配原则的具体化。对证明责任倒置规则的设置模式,应主要实行法定主义,由民事实体法和民事诉讼法共同作出规定,同时以司法解释进行补充,在没有法律规定和司法解释的特殊情况下,可以考虑由法官依具体情形自由裁量。

On the Reversion of the Common Rules in the Burden of Civil Proof

On the basis of the concept about the reversion of the burden of civil proof,this article analyzes the fourth item of the Regulation of Proof,which regulates the distribution of burden of civil proof of special tort cases.The view of inducing the regulation as the reversion of the burden of civil proof is a only one-sided,and most provisions of that responsibility should be understood as a concrete manifestation of the principle of distribution.The model of the regulation in the reversion of the burden of civil proof,the principle of statutory are proposed in this article.Civil entity law and civil procedure law should be regulated,supplied by judicial interpretation,the judge's discretion can be considered according to the specific case on the circumstances of lacking law regulation and judicial interpretation.
