法制建设推动电信强国战略

Legal System Consolidation Boosting the "Telecom Power" Strategy

The paper introduces the status quo of the telecom industry of China. At present, Chinese telecom industry lacks of national industry policy and strategic planning; its entire innovation ability still has much space for improvement; core technologies are under the control of other countries; the structural imbalance hinders the potential for further development of the industry; and the comprehensive competence of Chinese telecom enterprises needs enhancement. Moreover, the paper discusses the close relationship between the establishment of telecom law and the implementation of the strategy of "Telecom Power". It proposes general guidelines on the establishment of telecom law during the eleventh five-year plan period of China: the purpose of legislation is to foster competition and protect consumers' rights and interests; based on the Telecommunication Law and supporting regulations, a perfect law system should be established; the management and supervision system of Chinese telecom industry should be improved to form unified and harmony guiding principles and policy measures; a scientific legal evaluation system should be established; and it is important to coordinate with relevant important legislation.
