2004年《对外贸易法》修订特色分析

外贸法的修订表明,我国外贸工作正在适应当前国际国内环境特别是加入WTO以后所面临的新形势的要求,体现了可持续发展、履行入世谈判承诺、依法行政等方面的需要.新外贸法反映了国家对外贸的适度管理、市场开拓、贸易促进、损害防御和机构监管等价值取向,在内容上调整比例近90%,新增了个人外贸资格、备案制、贸易公平和透明度等重要制度.

The Analysis on the Characteristic of the Foreign Trade Law Published in 2004

The modification of the Foreign Trade Law reflects the fact that Chinese foreign trade business is sulting to the international and national environments, especially after Chinese entry to WTO, and showing its notion of sustainable development, confidence the realization of the WTO commitments, and the legal administration, etc. The new foreign trade law shows the value orientation of China government on the market development, the business improvement, the loose protection and the supervision, and the suitable management of foreign trade. Regarding the content, up to 90 % has been modified and the personal certification of foreign trade, profiling sys- tem, fair and transparent trade system has been added.
