一起不服食品卫生处罚的行政诉讼案的分析及思考

2001年7月，江苏省盐城县卫生局对收购病死鸡585kg，准备用于加工成食品的某食品店店主进行了销毁病鸡，罚款人民币6000元的行政处罚，店主不服，提起诉讼，盐城市城区人民法院审理后，认为盐城市卫生局的行政处罚事实清楚，证据确凿，程序合法，量裁得当，维持了盐城市卫生局的行政处罚，卫生行政部门通过此案取得了一定的经验与教训。

Analysis and consideration of an administrative lawsuit for disobedient to food safety punishment

In July 2001, the Health Bureau of Yancheng Jiangsu Province administered an judgment of burning out the sick and dead chickens and a penalty of 6 000 RMB to a food merchant who had purchased 585 kg sick and dead chickens to produce food. However, the food merchant prosecuted an appeal for disobedience to the punishment. The People's Court of Yancheng heard the case and affirmed the original judgment in consideration of the clear proof and irrefutable testimony. Some experiences and lessons were learned by the health administrative agencies from this lawsuit.
