从业主方角度看施工索赔应注意的事项

本文从业主方的角度,论述了承包商在提出工程施工索赔应注意的事项——“三全”:全局性、全面性、全过程“,三有”:有理、有据、有效,“三性”:理性、正确性、策略性,以及反索赔。进一步提出索赔前应积极与业主方沟通、协调,争取业主方的理解,达到既成功索赔,减少经济损失,又保持与业主方的长期合作关系,努力与业主方建立起一种相互信任、相互体谅、谋求双赢、共同发展的新型合作伙伴关系。

Considerations in Construction Claim from the Angle of Owners

From the angle of owners, this article discussed the items that should be considered when proposing a project claim, including "three overall"-global, comprehensive and full process; "three possession " -reasonable, evidence and validity; "three characteristics"- Rationality, accuracy, strategical, as well as counter-claim, and further proposed that positive communication and coordination with the owners before claim is beneficial to obtain the understanding of the owners so that accomplish not only success claim and few economic loss, but also keep the long-term partner relation with the owners, and try to establish a new type of cooperation relation based on trusting and forgiving mutually, seeking for win-win, and communal development.
