体育伤害事故防范与处理的法学解释——以“阳光体育活动”为例简

近年来，随着学生参加学校体育活动的兴趣性提高、参与意识性增强、项目对抗性的激烈程度加大，发生意外伤害事故的可能性增大，从而引发学校和学生家长之间诸多经济、法律纠纷的事情屡屡发生。如何防范与减少学校因体育伤害事故与学生家长之间的纠纷，有效推动学校体育工作的正常进行，全面提高学生的身体素质，本研究从法学的视角对体育伤害事故发生的起因、体育伤害事故的防范、规避以及学校与学生的法律关系进行分析，探索出台一系列的法规和办法，解决当前体育伤害事故的法律途径。

Juristic Interpretation of the Prevention and Treatment of Physical Education Injury Incident-- take Sunshine Sports Activities as an example

In recent years, as students are more interested in participating school sports activities and the antagonistic degree of activities is greater, the accidental injury is more likely to happen, which causes the dispute in finance and law between school and parents. Hence, it is often concerned how to prevent and decrease the dispute from the PE injury incident, to effectively promote the school sports work, and to fully strength the students＇physical quality. This study will give you the answer and make the analysis of the cause, precaution and evading of the physical education injury incident, and the legal relation between school and students from the juristic perspective, so that government could formulate a series of regulations and measures to broaden the legal approaches of dealing with the PE injury incidents.
