利用影响力受贿罪犯罪主体的争议梳理及解决路径

自《中华人民共和国刑法修正案（七）》增设了利用影响力受贿罪以来,关于该罪的讨论就没有停止过,争议的焦点主要集中于两个方面,一方面是关于该罪犯罪主体的范围,另一方面是关于该罪客观方面的理解.对该罪犯罪主体的争议进行梳理,认为本罪的犯罪主体应是一般主体,单位也可以成为本罪的犯罪主体.

Combing Dispute and Solution Path on the Subject of the Crime of Making Use of Influence to Take Bribes

Since the Amendment to the Criminal Law of the People’s Republic of China(Ⅶ) is added to the crime of making use of influence to take bribes,discussions on the crime did not stoped.Focus of controversy is in two aspects: one is about the scope of the subject of the crime,the other is on the understanding of the objective aspect of the crime.This paper intends to sort out the dispute on the subject of the crime,and has the opinion that the subject of the crime should be the general subject,and the unit can also be the subject of the crime.
