行政指导在食品安全监督领域的运用

摘    要:随着"服务行政"理念的普及,传统上以行政处罚、行政强制和行政命令为特征的"刚性"管理已不能满足建设服务型政府的需要,在很多行政领域,"柔性"的行政指导成为传统依法行政的必要补充和灵活有效的行政活动方式。对食品安全监督领域中的行政指导的运用进行了探讨,以期行政主体进一步重视、探索和加强行政指导在当代行政管理中的运用。

Abstract:With the popularization of the concept of service administration,traditional "rigid" management containing administrative punishment,administrative coercion and administrative order could not satisfy the needs of the service-oriented government's construction.In many administrative fields,"soft" administrative guidance was gradually becoming necessary complements of traditional administration according to laws,and becoming a form of efficient and flexible administrative act.Accordingly,the application of administrative guidance to food safety administrative management was discussed in order to make administrative agencies focus on using administrative guidance in contemporary administrative management.
