| 摘 要： | 在输血感染案件中,血站所承担的民事责任性质应当是因缺陷产品致人损害的产品责任;就医疗机构的法律责任而言,存在着输血感染事故的责任竞合问题;对患者的损害赔偿包括患者及其近亲属的财产损失赔偿和精神损害赔偿。

It exists the responsibility compete gathers the question in the blood transfusion infection accident on the medical establishment＇s legal liability. To patient＇s damage compensate including patient and its close relative＇s property damage compensation and spirit damage compensate. |
