| 摘 要： | 法释〔2004〕14号司法解释对建设工程施工合同作出了全面规定,该解释内容详备,体现了以人为本的基本理念,但该解释仍存在一些问题。当事人应该深刻领会其精神实质,完善合同内容,加强规范性操作,力争在发包人与承包人之间寻求权利义务的平衡。
