| 摘 要： | 针对超龄劳动者在劳动过程中遭受的人身损害是否适用工伤待遇问题进行讨论，认为作为劳动者只要与用人单位形成了事实的劳动关系，工伤事故是因工作原因引起的，劳动者就可以向用人单位主张工伤保险赔偿请求。

| Abstract: | In this paper, the following problem is discussed,whether it is applied to industrial injury treament if an overage labourer is injured during the labour process. Once the labour relationship is formed by the labonrer and employing unit, and the injury is caused by work, the labourer can have the injuried insurance treatment. |
