基于制度设计视角的工程项目信任维持机制研究

在文献研究的基础上，提出了制度设计是维持工程项目中信任的有效途径。通过对业主方工作人员进行访谈，得出承包商在项目进行过程中可能做出的辜负与不辜负信任的行为集合，在此基础上进行第二次访谈，考察了能够在合同谈判阶段加入的应对承包商上述两类行为的条款，从而得出业主维系信任的策略矩阵。结果表明:可通过对两种类型的条款进行设计来保证项目中的信任有效维持；基于业主的视角，对于承包商不辜负业主信任的行为，业主可以使用激励类、事后商议类的柔性条款促使鼓励，对于承包商欺骗和自利等辜负业主信任的行为，业主可以使用惩罚类、保函类和清晰规定合同事项及界限的刚性条款进行约束。

Trust Maintaining Mechanism in Construction Projects from View of System Design

Abstract:approach in this paper. Eighteen staffs from employers were interviewed to get a collection of contractor’s potential behaviors that will cause either a maintaining or a decrease in the trust. Then, a second interview was held to explore what kind of contractual terms that employers can use to deal with the two kinds of behaviors. An employers’ strategy matrix of maintaining trust was built. Maintaining of trust in the construction project can be achieved by designing two types of contractual terms. Flexible terms involved incentives and renegotiation can be used to encourage the contractor to make performances that will maintain trust. Rigid terms involved punishment and guarantee can be used to restrict the contractor to make performances that have the potential to decrease the trust level.
