| 摘 要： | 与发达国家相对成熟和完善的规制知识产权权利人滥用诉权的法律救济制度相比，我国有关法律还很不完备，难以承担起有效惩处滥用诉权，同时保障合法诉权的重任。我国有必要借鉴发达国家的有关立法和司法经验，运用《反垄断法》加大对滥用诉权行为的惩罚力度，并对以侵权诉讼相威胁的行为规定救济措施。
