| 摘 要： | 通过对我国建设工程施工合同备案制度的实证考察,将当前施工合同备案划分为记载式、确认式和批准式三类。在此基础上,结合施工合同备案的具体规定将其在性质上分别归为行政事实行为、准行政法律行为和行政法律行为。最后,建议制定统一的建设工程合同备案制度,并采用性质上属于行政事实行为的记载式备案方式,以防止行政权力对建筑市场的过分干预。
