| 摘 要： | 用"归责标准"取代"归责原则"更合理,归责标准实际上是仅与损害赔偿责任相联系,而 与其他责任形式没有关系。侵权损害赔偿归责标准体系是由过错归责标准、危险归责标准、受 益归责标准组成,这三大归责标准之间的关系不是"地方割据"式的,而是环环相扣、密切相连 的。

| Abstract: | It is reasonable to substitute "criteria of liability" for "liability principle" because the criteria of liability is only related to damages, not to other forms of liability. The system of criteria of liability in tort damages consist of fault - liability, danger - liability and benefit - liability. The three criteria of liability are not separated, but closely related to each other. |
