统筹城乡背景下的城乡规划地方性立法实践——以《重庆市城乡规划条例》为例

本文以《重庆市城乡规划条例》(以下简称《条例》)的制定为例,介绍了在《条例》制定中对统筹城乡这个重大命题的一些思考,探讨了如何建立统筹城乡的规划管理体制,完善规划编制体系,赋予镇、乡人民政府的规划管理职责,严格规划的编制和修改程序,规范建设工程特别是农村地区规划许可和监督管理制度,明确违法建设查处的部门职责,完善处罚形式等问题,并根据重庆市地方实际进行了多处创新,是对我国城乡规划地方立法一次大胆尝试,希望对推动全国统筹城乡的规划制度改革有所借鉴。

Local Legislative Practices in Urban and Rural Planning against the Background of Unified Urban and Rural Planning

Taking the settlement of the Ordinance of Urban and Rural Planning of Chongqing(the following part will use the Ordinance for short) as an example,the writer introduces some thoughts about unified urban and rural planning which is an important and serious topic,and then explores how to establish management system of unified urban and rural planning,and how to optimize planning preparation system.The thesis also covers topics as follows:the responsibilities of planning management given to township government,preparation with strict planning,strict procedure of amendment,standardization of the system of supervision and management and the permission of construction especially in the rural area,clarification of the department’s duties which deals with the illegal construction cases,and optimization of the forms of the fine.Moreover,in combination of the practical situation of local places in Chongqing,the writer hopes that much innovation can be witnessed,which is a bold attempt in the field of national local legislation of urban and rural planning.The whole thesis is expected to be helpful to promote the reform of national unified urban and rural planning.
