论法的价值取向

法的价值取向受制于特定的文化渊源；法与文化虽然不是同一的，但就其功能而言，二者是相通的；中国与西方法的价值取向的差异得以产生的根本原因之一就在于不同的文化背景；对于转型时期的中国社会来说，确定其法治模式的根本途径，就在于立足本土，关注其文化背景，以适应大众生活的需求作为法的价值取向。

On Value-orientation of Law

The value-orientation of law is based on the specific origin of culture.Although the law is different from culture, they are identified in terms of their functions. one of the basic differences in the value-orientation between Chinese and wesmner laws is due to their different cultural background. For the Chinese society which is undergoing social transition, the fundmental approach of establishing the pattern of rule by law shouid be based on its native land and be concerned with its cultural backgroundso as to meet the needs of the people's life as the value-orientation of law.
