生产者延伸责任制下的中国汽车回收利用体系研究

在中国国家“十一五”科技支撑计划项目《报废汽车绿色拆解处理与利用关键技术及示范应用》，以及上海市科技发展基金项目《乘用车回收利用关键技术研究与应用示范》共同资助下，以上海汽车产品回收利用体系为研究案例，探索建立基于生产者延伸责任的中国汽车产品回收利用体系，提出研究报告。讨论面向EPR的中国汽车产品回收利用体系的行政法框架。通过回顾EPR的内容框架，提出汽车产品生命周期中生产者的延伸责任结构框架；通过EPR的调整机制，提出实施EPR所依据的生产者延伸责任经济调节与行政管制手段的决策矩阵。通过讨论“2000/53/EC指令”，建立EPR责任模式框架和生产者延伸责任应对策略框架；以德国为例，提出了面向EPR的报废汽车回收管理模式。解读已经初步建成的由法律框架、行政政策和技术规范共同组成的面向EPR的中华人民共和国汽车产品回收利用的行政法框架，解释由中华人民共和国发展和改革委员会、中华人民共和国环境保护部、中华人民共和国科学技术部联合发布的《汽车产品回收利用技术政策》所涉及的主要内容

A Study on China Automotive Products Recycling System Based on Extended Producer Responsibility

Funded jointly by “The Key Technique Investigation & Pilot Project of ELV Dismantling & Recycling”, one of the key projects of National Key Technology R&D Program during the Eleventh Five—year Period and “The Key Technique Investigation & Pilot Project of Passenger Car”, Shanghai Science & Technology Fund planning project, this study, taking Shanghai automotive products recycling system as the case, explores and establishes China Automotive Products Recycling System based on Extended Producer Responsibility (EPR), and makes a research report. This paper discusses the framework of administrative laws for EPR oriented automotive products recycling system in China. Reviewing the content framework of EPR, this paper puts forward the structural framework of EPR in the life cycle of an automotive product and Decision—making Matrix for Economic Modulation & Administrative Regulation Means of EPR, on which the implementation of EPR is based, upon the Regulation Mechanism of EPR. The paper establishes EPR model framework and EPR strategy framework through probe into “2000/53/EC Directive”.
